Terms of sale

1. Purpose and scope

These general terms and conditions of sale (hereinafter "Terms") govern the contractual relations between Maison Ashoka and any natural person of legal age acting for purposes that do not fall within the scope of their commercial, industrial, craft, liberal or agricultural activity (hereinafter the "Customer") making a purchase on the website www.ashokaparis.com.

These Terms apply exclusively to relations between Maison Ashoka and consumer Customers (B2C). Conditions applicable to professional relations (B2B) are subject to separate specific contracts.

Any order implies full and unreserved acceptance of these Terms.

3. Products

  • The products offered are those described on the website, subject to available stock.
  • Maison Ashoka endeavours to present accurate and up-to-date information. In the event of an error or unavailability, Maison Ashoka cannot be held liable.
  • Maison Ashoka products are designed from plant-based or synthetic materials of non-animal origin. The exact composition of each product is specified on its product page, in accordance with applicable regulations, in particular French Decree no. 2010-29 of 8 January 2010 on the use of certain commercial designations.

Made-to-order products

Some items, in particular vegan fur coats made by our Parisian partner workshop Maison Quivernay, are made to order. These pieces are produced only after order validation, according to the models and colours offered on the website.

The manufacturing time is indicated for information purposes on each product page. It may vary depending on the period and production load. A slight delay shall not constitute grounds for cancellation or refund.

Made-to-order products retain the same rights as other items, in particular the right of withdrawal of fourteen (14) days from receipt, in accordance with articles L.221-18 et seq. of the French Consumer Code. They must however be returned new, unworn and in their complete original packaging.

Any request for modification or cancellation after order validation must be subject to the prior written agreement of Maison Ashoka.

4. Prices

  • Prices are indicated in euros, all taxes included, excluding shipping costs.
  • Shipping costs are specified at the time of order. For details by country, see our Shipping Policy.
  • Maison Ashoka reserves the right to modify its prices at any time. However, the price applied is the one in force at the time of order validation, without retroactivity.
  • Products remain the property of Maison Ashoka until full payment of the price.

5. Orders

Purchasing on the website is reserved for natural persons of legal age (18 years and over) with the legal capacity to enter into contracts. Maison Ashoka reserves the right to request proof of identity in case of doubt.

The ordering process includes:

  1. Selecting items and adding them to the cart
  2. Verifying the cart and choosing delivery
  3. Creating or logging into a customer account
  4. Accepting the Terms and validating
  5. Secure payment
  6. Order confirmation sent by email

Maison Ashoka reserves the right to refuse an order in case of fraud, manifest anomaly or previous dispute with the Customer.

6. Payment

Payment is made in euros:

  • By bank card (Visa, Mastercard, Carte Bleue)
  • By PayPal
  • In several installments without fees via Alma (eligible between €50 and €2,000 — Customers of legal age only — secured by 3D Secure).

In case of accepted return, the refund will be processed via Alma: remaining installments will be cancelled and/or recalculated according to the situation.

Payments are secured by SSL and 3D Secure protocols. Maison Ashoka does not retain any banking data on its servers.

7. Delivery

Delivery is provided in mainland France, in Europe and internationally. For details of rates and delivery zones, see our Shipping Policy.

  • Indicative times: 2 to 5 working days for mainland France from shipment; 5 to 10 working days for Europe and international depending on country and carrier.
  • Maximum delay: unless otherwise indicated at the time of order, delivery will take place no later than thirty (30) days from order validation, in accordance with article L.216-1 of the French Consumer Code.
  • Notification: the Customer receives an email with tracking number upon shipment.

Customs duties and import formalities

For deliveries outside the European Union, Maison Ashoka ships orders under DDP (Delivered Duty Paid): customs duties and import taxes are included in the purchase price and entirely covered by Maison Ashoka. The Customer therefore has no additional fees to pay upon delivery.

Verification upon receipt

It is recommended that the Customer check the condition of the package upon receipt and report any apparent anomaly as soon as possible, ideally within three (3) days, to contact@ashokaparis.com. This report allows Maison Ashoka to best handle any transport damage. However, the Customer retains the full benefit of their legal rights, in particular under the legal guarantees of conformity and against hidden defects.

In case of confirmed non-conformity, Maison Ashoka will take charge of the return and proceed with the refund or replacement of the product.

8. Right of withdrawal and returns

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to justify their decision or bear other costs than those provided for by law.

  • Returns are free from mainland France.
  • From the European Union, return shipping costs are at the Customer's expense. A prepaid return label can be provided on request; its cost (approximately €9) will be deducted from the refund amount.
  • From countries outside the European Union, return shipping costs are entirely at the Customer's expense (except for non-conforming products).

Products must be returned new, unworn, in their complete original packaging.

Non-returnable products

  • Sealed products that cannot be returned for hygiene reasons once unsealed.
  • Perishable products.

"Archives" products

Items in the Archives category (from photoshoots, exhibitions or with minor aesthetic imperfections) are offered at a reduced price and sold as-is. They benefit from legal guarantees of conformity and against hidden defects, as well as the 14-day right of withdrawal for online purchases from within the European Union. However, the 1-year commercial guarantee does not apply to these items.

The refund is processed within a maximum of fourteen (14) days from receipt of the returned parcel, via the same payment method as that used at the time of purchase.

9. Personal data and cookies

Personal data collected by Maison Ashoka is necessary for order processing, customer relations and improving the shopping experience. It is processed in accordance with the General Data Protection Regulation (GDPR).

The Customer has rights of access, rectification, erasure, portability, restriction and opposition to the processing of their data, which they can exercise by writing to contact@ashokaparis.com.

10. Intellectual property

All elements of the website (texts, photographs, illustrations, logos, trademarks, editorial content, product designs) are the exclusive property of Maison Ashoka and protected by copyright and trademark law.

Any reproduction, representation, modification, publication or adaptation, in whole or in part, of any of these elements, whatever the means or process used, is prohibited without the prior written authorisation of Maison Ashoka. Any unauthorised use may constitute prosecutable infringement.

11. Force majeure

Maison Ashoka cannot be held responsible for the non-performance or delay in the performance of its obligations in the event of force majeure, as defined by article 1218 of the French Civil Code and French case law. In particular, the following are considered cases of force majeure: carrier strikes, natural disasters, pandemics, health crises, political unrest, customs blockages, or any other external, unforeseeable and irresistible event.

In such cases, Maison Ashoka will inform the Customer as soon as possible and agree with them on the appropriate terms (postponement, cancellation, refund).

12. Guarantees

Legal guarantees

All products sold benefit from:

  • the legal guarantee of conformity of two (2) years provided for in articles L.217-3 et seq. of the French Consumer Code. The Customer can require the repair or replacement of the non-conforming product, or, failing that, the reduction of the price or the cancellation of the sale.
  • the legal guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code, allowing the Customer to obtain the cancellation of the sale or a reduction in price if a hidden defect makes the product unfit for the use for which it is intended.

These legal guarantees apply independently of any commercial guarantee that may be offered. They are applicable to Customers residing in the European Union.

Maison Ashoka commercial guarantee

In addition, Maison Ashoka offers a 1-year commercial guarantee covering manufacturing defects. This guarantee applies worldwide and allows, depending on the case, the exchange, repair or refund of the product.

Terms for exercising the commercial guarantee:

  • Contact customer service at contact@ashokaparis.com specifying the order number
  • Attach photographs of the defect observed (overall view + affected areas in natural light)
  • The guarantee runs for one (1) year from the date of delivery of the product
  • In case of confirmed manufacturing defect, return shipping costs are entirely covered by Maison Ashoka, worldwide

Exclusion: items in the Archives category do not benefit from the 1-year commercial guarantee, but retain the legal guarantees (conformity and hidden defects) as well as the right of withdrawal for online purchases from within the European Union.

13. Disputes and mediation

These Terms are governed by French law.

In case of dispute, the Customer may contact customer service at the following address: contact@ashokaparis.com.

Failing an amicable solution, the Customer is informed that they may have free recourse to a consumer mediator.

Centre de la Médiation de la Consommation de Conciliateurs de Justice (CM2C)

In accordance with article 14 of Regulation (EU) No. 524/2013, the Customer may also use the European online dispute resolution platform, accessible at the following address: https://ec.europa.eu/consumers/odr

Failing an amicable agreement, the competent French courts may be seized, without prejudice to mandatory provisions more protective of the consumer applicable according to their place of residence.
